Terms and Conditions

By enrolling in our swim school, you agree to abide by the following Terms and Conditions. These terms are designed to ensure clarity, transparency, and fairness for both our students and our team.

Payment Terms

  • Payment Due Date: Payment for each term is due by the first Monday of each month as stated on your invoice. Failure to make payment by the due date may result in the suspension of swim lessons until payment is received.
  • Invoice Notice Period: Invoices for the upcoming month are sent out via email, included in this email will be the notice dates for the subsequent 3 months. Please pay careful attention to these dates. To cancel lessons, a minimum of four weeks’ written notice must be provided before the next invoice due date (the first Monday of each month). For example, if notice is given on the 20th of September, lessons will need to be paid for until the end of November as there are not four weeks before the October due date.

Refunds and cancellations

  • Refund Policy: Refunds are not provided under normal circumstances. Refunds or credits will only be considered for extreme situations such as medical emergencies (e.g., broken limb or surgery). Requests must be submitted in writing within 14 days of the issue arising and will be considered on a case-by-case basis.
  • Swim School Cancellations: If the swim school must cancel a class due to unforeseen circumstances (e.g., instructor illness or facility issues), a credit will be applied to your account and reflected on the following month’s invoice. We will notify all customers by text and request a response, if no response is received we will text a second time. If we still have’t had confirmation the message has been received we will try an alternate contact method i.e alternate number or email. After this we will not attempt to make further contact. Please make sure you keep us up to date with any changes in contact information.

Missed Lessons

  • We encourage students to attend all scheduled lessons. Unfortunately, we do not offer refunds for missed lessons due to personal reasons (e.g., illness, scheduling conflicts, etc.). However, in the event of extended illness or injury, please contact us to discuss potential options.
  • In the event a lesson is missed, if we have availability we are happy to arrange an alternative session. Please email the week you are able to attend a different slot. This is subject to availability.

Behaviour and Safety

  • All students must follow safety guidelines and instructions provided by instructors.
  • Parents or guardians are required to remain at the facility during lessons for safety purposes.
  • Brightwater reserves the right to suspend or terminate lessons without refund for students who breach safety protocols or exhibit inappropriate behaviour.

Changing Room Policy

  • Adults should only enter changing rooms when assisting children with dressing or undressing.
  • Individuals should use the changing room appropriate to their gender identity.
  • Children aged 8 or older are expected to change independently in the appropriate changing room. Please contact us if alternative arrangements are required.

Practicalities 

  • Attire: Ensure your child wears appropriate swimwear. Goggles are strongly recommended.
  • Belongings: Please carry all belongings onto the poolside. Brightwater Swim School is not liable for lost or stolen items.
  • Hygiene: Children must shower and use the toilet before entering the pool. Large meals should not be consumed within two hours before lessons.
  • Poolside Rules:
    • Do not wear footwear on the poolside. Blue overshoes are provided.
    • Children must not enter the pool until instructed by their instructor.
    • Eating or drinking on the poolside is prohibited.
  • Instructor Interaction: Instructors may physically assist children during lessons to aid with swimming techniques or pool safety. This is in accordance with safeguarding guidelines. If you prefer that instructors do not assist your child physically, please inform us prior to their first lesson.
  • Phone/ Photography: To ensure privacy and safeguarding, photography and video recording during lessons are strictly prohibited. Unauthorized use of cameras or phones may result in removal from the venue.

General Policies

  • Changes to terms: Brightwater Swim School reserves the right to modify these Terms and Conditions at any time. Changes will be communicated via email and will apply to all lessons occurring after the notification date. Continued attendance after notification constitutes acceptance of the updated terms.
  • Liability: By enrolling in Brightwater Swim School, you acknowledge the inherent risks associated with swimming activities. Brightwater Swim School is committed to maintaining a safe environment and following industry best practices. However, we cannot accept liability for injury, illness, or accidents occurring during lessons, except in cases of gross negligence or wilful misconduct.
  • Privacy & Data Protection: We are committed to protecting your privacy. Personal information provided during enrollment will be used solely to facilitate your swim lessons and will not be shared with third parties without your consent, except where required by law.
